DAS operators must navigate through a complex maze of regulatory entitlements and approvals in advance of construction. This adds uncertainty to the DAS permitting process. To promote consistency and certainty in DAS deployments, The DAS Forum actively advocates before federal, state and local governments, and serves as an educational forum for information about this wireless deployment tool.

T-Mobile USA, Inc. v City of Anacortes, Washington, U.S. Court of Appeals for the 9th Circuit, filed July 20, 2009
T-Mobile successfully argued that once it had made a prima facie case that denying a site location amounted to an effective prohibition under Section 332 of the Communications Act, the burden then shifted to the locality to show that there are available and technologically feasible alternatives to the proposed site. According to the 9th Circuit, the City of Anacortes failed to meet this burden.
